1. Acceptance of terms
By accessing or using the OPSControl service ('service'), you declare that you have read, understood and fully accepted these Terms of Use. If you do not agree with any part of these terms, do not use the service. Your use of the service is also subject to our Privacy Policy, which forms part of these Terms.
2. Description of the service
The service provides automated monitoring of the status of immigration (USCIS) cases based on the receipt numbers you provide, sending alerts when the status or date of last change changes. The service is a tracking tool and is not affiliated with, sponsored by or endorsed by USCIS, the United States government or any governmental agency.
3. Account and eligibility
To use the service you must be of legal age and able to enter into contracts. You are responsible for keeping your access credentials confidential and for all activities carried out in your account. You must provide true, current and complete information and keep that data updated. You agree to promptly notify OPSControl of any unauthorized use of your account.
4. Permitted use and conduct
You agree to use the service only for lawful purposes and not to: (i) reproduce, resell or exploit any part of the service without authorization; (ii) monitor cases that are not yours or for which you are not authorized; (iii) attempt to access unauthorized areas or systems; (iv) interfere with the operation of the service; or (v) use the service to violate the law. Monitoring the cases of third parties may involve processing the data of third parties, and you declare that you have the proper legal authorization to do so.
5. Registering your own Telegram bot
The service allows you to register your own Telegram bot to receive alerts about the cases you pay to monitor. When registering the bot, you are responsible for creating and maintaining the bot and for ensuring that the token and the chat identifier belong to you. OPSControl only sends messages to the token and chat you provided and is not responsible for the content, for Telegram's availability or for failures in message delivery.
6. Payments and refunds
Plan prices and payment processing are informed at the time of purchase. Access to the service is granted after confirmation of payment of the applicable amount. Unless the law provides otherwise, amounts paid are non-refundable, except in the case of a proven failure to provide the service, as analyzed on a case-by-case basis, or as provided by law (including the right to withdraw within 7 days of purchase, where applicable).
7. Alerts and monitoring limits
Monitoring depends on public sources of information and on third-party services (including the official USCIS channels). For this reason, alerts may be delayed, and the service does not guarantee that they reflect the most recent status at the exact time it is displayed. The service is provided with reasonable diligence, but does not guarantee the accuracy, completeness or timeliness of the information displayed. The information provided does not constitute legal advice. You should always confirm official information directly through official channels.
8. Intellectual property
The service, including all of its content, software, texts, graphics, logos and the OPSControl brand, is owned by OPSControl and its licensors, protected by intellectual property laws. No license is granted by using the service, except for personal and non-commercial use of the service in accordance with these Terms. You may not copy, modify, distribute or create derivative works without authorization.
9. Disclaimer of warranties
To the maximum extent permitted by law, the service is provided 'as is' and 'as available', without warranties of any kind, express or implied, including, without limitation, warranties of fitness for a particular purpose and of non-infringement. We do not warrant that the service will be uninterrupted, timely, secure or error-free.
10. Limitation of liability
To the maximum extent permitted by law, OPSControl will not be liable for indirect, incidental, special, punitive or consequential damages, including loss of data, lost profits or business interruption. The total liability of OPSControl for any claim arising from these Terms or the use of the service will be limited to the amount you paid for the service in the six (6) months preceding the claim. This clause does not apply where such waiver is prohibited by law.
11. Indemnification
You agree to indemnify, defend and hold harmless OPSControl, its directors, employees and providers, from any claims, damages, losses and expenses (including attorneys' fees) arising from your use of the service, your breach of these Terms or your violation of third-party rights.
12. Termination and suspension
We may suspend or terminate access to the service, in whole or in part, at any time, for cause, including breach of these Terms, misuse of the service or non-payment. You may close your account at any time. Suspension or termination does not affect obligations that, by their nature, should remain (including payments due and the provisions of this section).
13. Changes to these Terms
We may change these Terms at any time. The current version will always be published on this page and indicates the date of the last update. Substantial changes will be communicated to you. Continued use of the service after the changes constitutes acceptance of the new Terms.
14. Governing law and jurisdiction
These Terms are governed by Brazilian law. For any dispute arising from these Terms or the use of the service, the courts of the user's domicile are chosen, in accordance with the Brazilian Consumer Protection Code where applicable. If the user is located outside Brazil, disputes will be submitted to the legal provisions and forums applicable to their jurisdiction, in accordance with international law.
